    Will 8821 work for this?

    Amending 2009 tax return for which husband and wife were alive and signed return. Husband died early this year 2011. Will the IRS accept an 8821 only signed by the spouse of the 2009 tax return?

    Sign as surviving spouse.

    I would think that should do it. But why don't you just execute a 2848?

      Form 56 and form 1310?

          I typed the surviving "spouse name - surviving spouse" on bottom line and she signed. IRS had no problem accepting it. Thanks for the help everyone.
