    What about Taxpayer Advocate? They have helped a client of mine fast and to our full satisfaction. Even called me several times to make sure the issue was resolved.

      For the THIRD TIME I say: Contacting your Congressmen is a LAST RESORT only to
      be used when all other methods to resolve the issue has been exhausted. 99% of the
      time I have been able to correct the matter with a letter to IRS. But about twenty years
      ago I met with an IRS conferee and presented him with the tax LAW. He advised that I was
      correct but that the position of IRS was that the taxpayer had to pay the tax anyway.
      That was the ONE and ONLY time I wrote to our congressmen and only then did IRS
      concede the issue. Yes, by all means contact me after you have exhausted all other
      means to appeal a tax matter to no avail OR contact your congressmen.

        The client needs to petition the tax court, IMMEDIATELY. If he needs help in understanding the instructions (it's not really that hard) or maybe have a tax person look it over after he has filled it out you can assist him in making sure that the address is correct, etc. You cannot petition for him. He signs it and mails it certified receipt. The court will docket the case and automatically send it to Appeals. There you can resolve this, if the redetermination doesn't do so first. But don't wait for the redetermination to be handled, that 90 days is rigid and your client does not want to lose his due process rights by not filing. He can always cancel the court matter once it's resolved. You can represent him in Appeals even if the case is docketed in tax court.

        It is way too early to pester a Congresscritter about this matter. It can be settled easily and there will be no tax court hearing, but don't trust that it will be done in reconsideration.

          Thanks for all your suggestions and help.

          I called the phone number on the letter. She said she in the 8606 and the letter and it will get fixed. Client is coming by tomorrow to sign and I will fax. Should be taken care of with no problem.
