I have a client who I thought was going to mail in his extensions and payments but he did them online. Now he emails me that he did them online and that Alabama did not have the option of 40NR so he chose the 40 and he hopes they will be smart enough to figure things out when he files. Does he or does he not have a valid extension for the Form 40 NR that he needs to file in due time? Given that he still has most of Monday to act what should I advise him to do? I am thinking that since an NR Return can't be efiled most likely neither can the extension. I would imagine that he can get the payment he made Sunday night credited back to his plastic card but that he has to mail in an extension form and a check if he wants to have a valid extension and payment.

Extension
I believe Alabama will accept the same Extension Form to be executed as if he were a resident. As usual, payment is necessary if taxpayer is expected to owe.
Client does not have the option of choosing to file as Resident or Non-resident. If he has not been a resident for any part of the year, he files a 40NR, and Alabama is not set up to accept e-filing for a 40NR.
