Originally posted by erchess View Postthen it has to be amended by 4/15 or if it was properly extended then Oct 15. The rule is three years after it was originally due including extensions.
§7503 governs here. April 15 is a legal holiday in DC - the next business day is 4/18. October 15 is a Saturday - the next business day is October 17.

I could be wrong
but I think you have to figure out what day in 2008 the return was due including extensions and including whether the 15th that year was on a weekend or holiday and the amend must be postmarked by that date in 2011 even if that date is a Saturday or a holiday or whatever. If someone has a cite to the contrary then I'm wrong but otherwise that's what I have always been taught.

Cites to the contrary - READ sections §6513(b) (when taxes are deemed paid) and §7503 (time for performance of an act where last day is Saturday, Sunday or legal holiday).
