    Applying for an EIN

    Daughter of a deceased taxpayer needs apply for an EIN in order to file the estate tax return for her deceased mother. Daughter is the "successor trustee".

    On Form SS-4, they ask for the "Legal Name of Entity". Does the daughter make up a legal name or she has to follow certain rules in order to create the legal name?

      Legal name is "Estate of Mary Jane Doe." (Substitute real name.) You said "successor trustee," however, not executor? So is this an RLT now to be an Irrevocable Trust? If not, disregard and treat as estate.
