    NY state non resident

    I have a client who is not a resident of NY but inherited property in NY that was sold at a loss in 2008. We did the initial return which showed a capital loss carryforward.

    In 2009 I filed the NY non resident return with only the $3000 loss carryforward on it.

    Is it necessary to file the NY non resident return each year till the loss carryforward is used up? That will be about 20 more years.

    If there will be no other income from NY I would stop filing the return.

      Thanks Bob. I was hoping someone from NY would reply. I knew you would know if there were some special rules that would make this filing necessary.

      There will be no other income from NY in the future.
