    Adopting a foreign child

    I have a client that had a Judgement of Adoption to adopt a foreign child from Mexico in 2006. The adopted child was 16 at the time and in 2010 when the adoption was finalized she is now the age of 20. Does she still qualify as a eligible child?

    I just completed a foreign adoption tax credit. Had to mailed in. I would enter the kids DOB in the tax software and then open the adoption form. Its either a yes or no. TTB has a little about it.

      Was/Is the child a 'qualifying child'

      If able to claim as a qualifying child in those years I would have to assume that all the expenses incurred from the beginning of the adoption process up to and through the present would be deductible. All expenses up to the end of this past year should be deductible this year.

      My question would be concerned with the treatment of expenses incurred after the child ceases to be a qualifying child, which I presume from your question is not the case. I would still claim the credit and if any expenses were incurred after that point I would provide the IRS with an accounting of expenses for each tax year.

      As I am a newbie's newbie, I post this as much for my own edification as yours, and would appreciate anything that you have to offer. Please see my own post re: adoption and comment if you can.
