    Earned Income Credit

    Is a t/p between age 25-65 eligible for earned income credit if

    W-2 Wages while working under the $13,460 limit

    however, t/p is receiving 3rd party sick pay (disability) which is Non-taxable (t/p paid for the coverage through payroll deduction)

    which sick pay/disability amount is more than his wages?

    Haven't had this occur before .

    I don't find anything in TTB that says no

    but I think I would do some more checking before I claimed the EIC here.

      Pub 17, p. 235 has a bit of language on non-taxable disability pay & EIC.
