    Georgia and Federal Help needed

    A client was injured on the job in June of 1990. The accident was due to Hurricane Hugo. He broke is back for the third time in this accident and he retired on Disability. The company gave him a check in 1990 and Federal but not GA taxes had been held out. He has not thought he needed to file for any year after 1989. I can only assume that he had enough Federal Withholding because the IRS never came after him but Georgia did in 1994 and it has been on his credit report ever since. In 1994 he began to draw disability social security and that is currently his only income. How can I get Georgia off his back?

    I doubt seriously if he has the paperwork from 1990 and if he does not, how can I file his returns? I don't believe that the IRS or GA will have transcripts going back that far will they? Also who can tell me about Georgia's procedure for dealing with taxpayers who are too poor to pay their tax bills?

      Just remember that Georgia starts with Federal AGI. So whoever did his returns back then must have incorrectly subtracted the amount as an adjustment in part 1.

      Many payers I've noticed in such cases do not withhold state tax, on the premise that they have no situs in that state.

        He didn't file for 1990

        or any subsequent year because he didn't think he had to. For one thing due to divorce and low income he moved at least three times in the last half of 1990 alone. It never occurred to him to tell the government about his moves.

          Well, if it's on his credit report, that means he owes for that year, because the tax has been assessed. Only thing to do is to pay them.
          Hopefully there are no more years that Georgia knows about.

            Erch.. I would call one of the regional offices. Ask him what county he was in during that time. Call one of the regional offices (not atlanta if possible) and tell them that you are calling about a past due amount on a individual return and tell them the county. If it is not the right office they should tell you which one to call.

            It is easier to talk to the agents at the regional offices then Atlanta. If you can't get in touch with the agent for that county... call back and ask the person that answers the agents email address. You can often get a quicker response that way.

            He will either have to pay it or maybe you can get an agent to write the amount off due to his limited income. Explain the situation you never know.

              Sometimes the Feds

              want all returns filed before they will negotiate. I thought GA might do the same thing but I was hoping they might not.
