    Spouse Taking AmerOpp Education Credit Revised Question

    I have a client that the spouse is an LPN. She is currently enrolled in a college to obtain an Associate Degree in Science for RN. I was going to just give her Tuition & Fees Credits and then noticed on her 1098T it says she attends 1/2 time. Since the prior school she went to did not give her any degree would others agree that since she is at least 1/2 time and going for an actual degree that I could use the American Opportunity Credit.

    Just had to research this. The AOEC replaced the Hope Credit and is only for those who have not completed the first 4 years of post-secondary education prior to 2010. If she fits this definition, she can take it. (It doesn't say the 4 years have to be consecutive, nor is there an age requirement.) Tuition and Fees is an above the line deduction. Lifetime is a credit.

      I agree, Plus keep in mind that it only matters if the college says that you don't have the credits to be considered having completed the first four years of college, so student could be in 6th year and still not has the necessary credits.

      As I have learned now, the combined HOPE/AOC credit can be taken on only 4 tax returns, but you can pick and choose as long as you fit in above.
