    First Home Buyer Credit, than company moved you.

    My client brought a house with first home buyer credit. 6 months later the client moved to another state. The primary residence changed to the new home in another state. How can the client get exception on the sale of the home that credit for first home buyer credit? I did not see any instructions about moving because of your job on instruction 5405.

    What is unclear?

    The taxpayer must recapture the credit amount up to the amount of any gain on the sale. I'm not sure what if there was a loss on the sale. But there are apparently no exceptions to the rule that if the house is sold or ceases to be principal residence within three years of purchase, recapture up to amount of any gain is required. Where I'm not clear is what if there is a loss or break even. Perhaps there is no penalty but it would be nice if TTB said so.
