    Complicated issue

    Maybe actually it is not really that complicated.

    Taxpayer had forgotten to claim a deduction on Schedule A in her 2008 tax return. So she had her tax preparer to prepare an amended tax return. But then she was also in health problem at that time and the amended tax return was not signed before she passed away.

    Now her daughter, who is the executor of the estate, wants to file the amended tax return for the refund.

    Can she sign the amended tax return as the executor of the estate? And who should the refund be made payable to?

    I would file the amendment, along with the form 1310. That way she can get the check in her name.
