    Late filed 8453 with schedule D-1?

    I'm filing this form late. It's merely a paper listing of capital gains transactions. It's merely support for the totals which were efiled on Schedule D.

    I'm guess (or hoping) that this isn't going to cause any jam ups. No problem for my client nor my authorized ERO status.

    Am i correct?

    (as always, thanks for the feedback. this site has been invaluable to both my clients and myself)

    Looks like you're doing it right. Page D-6 Schedule D instrucdtions (far right, top portion) explains it that way.

      Is there any penalty for filing an 8453 late?

      thanks for reading and responding.

      Yes, having read the posts of others, i am now fairly confident that i am doing it right. But i was supposed to have mailed months ago.

        Not likely to be any problems

        if you send it in now. If theIRS didn't receive it in a timely manner they will send a letter saying you didn't send the 8453 for a return as required and that it must be remitted immediately, or else. (They certainly won't admit they lost it). Sending them a second copy by certified mail has taken care of the matter with no further problems or fines.

        They might cross in the mail at this point because it takes them several months to notice that they didn't receive it.

          And i hope that they send the letter to me, ONLY to me and NOT to this client. Don't want this good client and his associates to think i don't know what i'm doing.

            They send the letter to the ERO so your client won't know about it.
