    If client can get his physician to fill out and sign the form that is included in the Sch R directions regarding "permanently and totally disabled" do you see any problem with me removing the 10% penalty of $14,000 from his return on 401K and IRA withdrawls (1099R's)?

    No ,Not at all.
    Everybody should pay his income tax with a smile. I tried it, but they wanted cash

      That would probably cover it. The IRS has not given any guidelines on supporting the exception. Note that the doctor must show a starting date--only distributions after the disability began would qualify.
