Asphalt company lays everybody off in November and hires people back to May. How can that count. Most have been unemployed the previous 60 days. Is there some seasonal exception that I am missing???

I have spent
some time the last couple days researching this more. The FAQ's on the IRS web page very specifically state that you can hire back your employees as long as they meet the requirements.
The real headache is going to be for the people hired before March 19 that were paid in March. Those days paid in March will have to be seperated from days worked in March but paid in April in order to get the credit on the 2nd QTR 941. The draft is up, check it out. Also means the second quarter 941 will be different from ALL other quarters. Talk about fun for programers!!!
This is not going to be easy for those of us that have payrolls in house.AJ, EA
