    Does this TP even need to file tax return?

    Filing MFS with only $11,195 of unemployment benefits with NO withholding.

    Yes, the gross income is more than $3,650.

      I was about to go into a speal about not being required to file if under age 65, etc. but THEN I noticed it said
      they were married filing separate. One thing interesting is that some states like S. C . addback the $2400
      exclusion from unemployment compensation where some states like N. C. do not. You would think they
      would get together but that is too much to ask.l

        filing requirement for mfs is $9350 isn't it? but he would file to show the 2400 exclusiion and no tax liability.

          The requirement is $3,650. If spouse itemizes the standard deduction would be $0.
