    Medical expenses for non-dependent

    Daughter earns $40000+ in 2009 by june of same year - falls ill and the parents end up paying $30,000 out of their pockets for medical expenses and treatments. Can the parents deduct the costs on their return sch A?? They have sufficient income to justify.

    Check TTB 4-7 & pub 17, p. 146. The definition of "dependent" is relaxed for purposes of the medical expense deduction. Parents may be able to claim the medical expense deduction even without claiming the daughter as a dependent. The gross income test doesn't apply, and if the other dependency tests are met, it might wotk out for them.
