    TP moved in to his rental TP owns in which TP use to rent

    Client moved into his rental in 2009 that he has been depreciating since 2006. All my other clients sold their rentals so this is a first for me. Is this considered a "dispostion"?

    No, not until it is sold. Then you have to apportion between sale of personal residence rules (at that time) for the period of personal use and sale of rental property rules for sale of business asset. Shouldn't be any Sect 179 recapture since you can't 179 on a rental.
