    Per Diem

Can Per Diem be used for Temporary Job Assignment (Electrical Construction Worker) that lasted less than 12 months ( only about 10.5 months) ? Employer did not reimburse any living and/or meal expense. Different State than Residency.

T/p had a travel trailer that he rented space in the vincinity of the Job location (city).

    Thanks,

    Sandy

    Don't see why not

I don't have a cite but I think so. Anyone care to disagree? I've been corrected before but it seems like he has a main tax home and he worked away from it for ten and a half months.......

Perdiem can only be used for meals. Lodging must be actual cost.
In other words, a democratic government is the only one in which those who vote for a tax can escape the obligation to pay it.

        I have a question - similar circumstances -

What about travel expenses (mileage) between work and tax home on weekends?

Sorry if this has been answered before, but I can't find info by searching.

If it's a temporary work location I would say yes.

            Temp Assignment

Thanks B Hoffman for posting, as that was another question I had.

Temporary job assignment (which is over) Feb 09 to Dec 12th 2009,

Can the client take the deduction for mileage home on weekends, and then we reduce by the lodging expense. Do you show that mileage separate for any other mielage from say going first job location to second job location in one day, or just combine all mileage?

Per Diem for M&IE accounted for work days?

It might be possible on temporary job assignment then to have the mileage reduced by lodging expenses, plus the per diem for meals and incidentals?

Here are the rules (hopefully in simple words, but mind is very tired)

If this is one job location, then only first trip to job and last trip back home are fully deductible.

All job miles from travel trailer to job are deductible.

All home trip are limited deductible: The lesser of actual miles OR what it would cost to stay at job site. If travel trailer is used that means meal per diem only. So, f.e. if TP is off Fr-Sun, 3 x $38=$117. If this is less than mileage he gets $117. If mileage is less he gets mileage.

              Alles klar? (Everything clear?)
