    lodging expense for truck drivers

is it true that even if a truck driver sleeps in his truck he can still deduct $70.00/ day for lodging expenses??

    thanks

No. There's no per diem for employees to use for lodging expenses.

There is no per diem for lodging for tax returns, period. Only employers can reimburse employees using per diem for lodging.

Probably OP is thinking of the deduction for Meals and Incidental Expenses.

The trucker who sleeps in his truck has the tax savings of depreciating the whole truck including the part of the cost that was for the sleeping compartment.

thanks erchess but this trucker is an employee and does not own the truck and sleeps in the truck, and is adamant that he should be allowed $70.00/day even though he slept in his truck

And I'm sure you will be equally adamant in not taking this $70 per day, something he's
heard at all the truck stops across the country.

After all, he does get the $52 for meals, or higher depending on where he was.

I'm always amused every year to hear what all my really good and faithful trucker has been hearing, tax tales from the heartland so to speak. We always have some good laughs at
what's said to be deductible this year.

No it is specifically stated that sleeping in the vehicle does not qualify. It is also in the
              TTB
