    Active Participation

    A taxpayer owns an out of state residential rental property. The taxpayer hired a professional property manager to do the day to day managment of the rental.

    Would the taxpayer be considered to have met the active participation rule to claim a rental loss?

    If the taxpayer has final say over whatever the management does. i.e. renter, repair company, cost of repairs etc
