    Single- House-married

    Sometimes coming up with a title can be confussing but here goes. Single taxpayer, single spouse. Taxpayer purchased house 2 years ago - still has it BUT converted it to rental due to moving out state. Taxpayer meets girl - then moves back to home state. Single lady purchase a house 5/22/09 - they get married 5/30/09. Both names on the HUD statement as a/k/a single lady x and single y for taxpayer. Lady x never owned a house AND the house was purchased for a fixer up - so cheap - under $60,000. So would she qualify for the FULL 10% since she orginally purchased the house and her name is on it first or do I split it or what.
    I hope these tax laws settle down....so confussing sometimes on who, what, where, and why they are deducting or getting as a return.
    Any suggestion on her claiming the 1st times home buyer credits? I think she can do it - it is under the $8,000 and the $6500.

    She Qualifies

    She qualifies and was not married at the time of closing, so his owning a home does not taint her. You said fixer-upper, though. Did she occupy the house before marriage? I'd do more research if she purchased it but had not occupied it as her principal residence before the marriage.

      Yes - I forgot to mention that. They were in the house just doing room by room and finding out the problems of remolding...tear one wall down - got another problem behind it...the joys of being youg.
