If someone is buying a house now and closing before 5/01/10 and they have already filed their 2009 tax return, are they allowed to amend their 2009 tax return and claim their FHBC for tax year 2009?

I believe so. It is the TP choice, doesn't matter if original or amended tax return.

I just wasn't sure if buying this year allowed them to go back to 2009 for credit.
