    Amending 2006 tax return including exts pg 15-5 TTB

    Its my understanding the window will close @ 12:01 am April 16th, 2010.

    If they filed an extension for their 2006 tax return, the window will close @ 12:01am Oct 16th, 2010

    Is all that is required is the envelope be postmarked no later then April 15th, 2010 or Oct 15, 2010?

    Certified "return receipt" as "postmark" could be challenged?

      I have learned from past exp. that get the return to them b4 that deadline. Auditor once told me just because you have a postmark doesn't mean the return was in the envelope.

          I had a corporate client last year who was assessed over $2,000 in late filing penalties in an audit because IRS records showed the return as being late-filed. I gave the auditor copies of the Certified Mail & green Return Receipt card for both the extension and the return and she immediately revised the RAR and removed the penalties.

          Anyone at IRS who tries to argue that there's no way to prove the contents of the envelope is blowing smoke (or inhaling it). The whole game might change once eflinging is mandated, but for now they have to follow their own rules as they are currently written. The postmark is proof of filing unless IRS has valid information to contradict it.

              is open now like that, but sounds like it will be the first budget cut back. B's do not tell me you have ever used that..??

                The U.S. Tax Court has many cases involving the 'Post Mark' and the majority come down to a legible dated U.S. Post Office post mark. If any of these requirements is not met then the IRS could challenge them. So you might want a hand canceled with proof of mailing that includes the date clearly displayed.

                But the IRS agents can still play dumb and argue, because they know it is cheaper for the individual to pay and move on than contest the issue.

                  When we lived in South Mpls, my wife used it often to mail payroll tax returns that were due that same day. I of course never needed to because I never waited until the last minute.
