    A Question

    On dependency and EIC. I have a client, married with twochildren all whom live at home.
    He also has a child byanother woman all of whom live in a separate home. He does provide some support to that child all of which wouold be difficult to document. Now can he claim that third child as a dependent and also for EIC. The income levels qualify for EIC.

    I don't do many EIC returns, but doesn't the child have to live with your client to qualify the client for EIC? And, to claim a child who lives elsewhere, your client needs a Form 8332 from the custodial parent that you will mail in.

      The child has to have lived together with him for more than 6 months in the US in 2009.

        Dependency

        However if he has the mother's permission to carry the other child he may claim that child as a dependent but of course she won't be able to get EIC on that child.

          If mom (custodial parent) allows dependency exemption to dad, then she can still get EIC for that child; as others noted, dad cannot.
