    Home buyer credit

    Taxpayer has a home that he has lived in for 6 years. The now wife - which got married 10/24/2009 owned a home in 2007 - sold May 2007. The newlyweds purchase a house on Jan 13, 2010. The taxpayer still owns his original home but now live in the new home with the wife. It has been 2 years and 8 months for the wife since she owned the home. So am I reading that since they got married and purchased the house together in 2010 and he still owns his house and it has not been 3 years - they do not qualify for the $6500?

    The income and all other stuff will let them qualify except if reading it right - throws it out for both that it has not been 3 years or am I just too tired of reading these laws that keep changing.

    Any input cause they are saying they qualify....so stressed.
