    MFS is used can you be a dependent

    Daughter msrried Nov-lived at home and went to college up to marriage. Can new couple file MFS and parents keep daughter as a dependent????

    Need more info. How old is daughter. Did her parents provide more than 50% of her support How much did daughter earned.
    How much did the new couple earned. Does the new couple have to file a return or they just need to file to get their refund.

      Under 24 and a full

      time student. Parents provided more then 50% 2005 and probably will in 2006 also.

        Daughter can be a dependent. It is MFJ where you would have a problem, but MFS is OK.

          The new couple can still file MFJ and the spouse can still be claimed as a dependent by her father. The only reason for MFJ is to get their refund eg

          Total income 12000 - spouse did not work

          Federal Withholding 1200

          They can file jointly to get the refund of 1200 . She will also check the box to say that she can be claimed as a dependent.

          If the taxpayer files mfj he will not get the full refund
          12000- 5000-3200=3800*10%=380

          his refund will be 820.

          MFJ =12000-10000-3200=00
          Now let us say the couple made$20000. In this case MFJ is not allowed if the father is going to claim the daughter. In this case they are required to file a return

          MFS would be appropriate then
