If you mean a Schedule C biz, then no.

Are they a sole proprietor or do have them formed an business through the state and are a corporation?

Sole proprietor is a schedule C person and cannot give themselves a w-2.
If they are a corporation, they would be an employee of corporation and would receive a w-2.
