    Form 1040 X

Do we need to use the new form now? Can we continue to use the old one that is with the year (in program) we are amending?

I saw in TTB that there is supposed to be a new version without the 3 column format; but when I searched the IRS website, the 2/09 version is still there. Maybe someone else has better info on this - I am interested because I will have a 2008 return to amend to add the FTHB credit.

If I'm amending a 2008 return or earlier, I must use my software for that year, and it does
not support the new format. So there!

          the irs realizes that.

One of the courses/seminars I went to in the fall of '09 had representatives from the TAO. They said the IRS is not going to kick back any 1040X's sent in on the old form.
Just because I look dumb does not mean I am not.

If you are doing a prior year amended return it seems reasonable that you would use that year's amended form....after all....you would not use 09 forms to do an original 07 return.
Believe nothing you have not personally researched and verified.

                New 1040X

The new 1040 x has check boxes on it for years 2006 thru 2009.

Which is why I asked, but today I asked my software company and they said it was fine. Not that they have an authority for tax law, but it helps in the overall viewpoint.

Prefer to use amended form that came with software

It's a heck of a lot easier to use the software that contains the amended returns corresponding to the tax year of the "original" return.

Along similar lines, does anyone know if an amended NY return can use the forms for the "original" year or must instead have one of the recent forms with the magical NY preparer number shown?

Unlike the Federal 1040-X, the NY amended form itself is year specific. To amend a 2008 IT-201 return you must use a 2008 IT-201-X. And that form (as of today) has no box for the NYTPRIN.

I think I heard just to use the 1040X that is in your program. The new 1040X has just skipped column 1 and column 2, and is now just using column 3. WELL column 3 is on the old forms. I see no problem.

Thank you very much! That is what I was hoping....but you just never know these days. I probably will have to amend 2007 and 2008 returns.

And of course, since NY is not sending out any 2009 Forms 1099-G, and the electronic information for same is not available online until Feb 1st.....the wait continues.

The changes are basically some Schedule A issues. Does NY like to look at the federal 1040-X and/or Schedule A, or just keep them "available" ??

The IRS has not posted the new format on their web site as of today.

Since you don't send in a copy of the Federal Schedule A with your original return, I've never sent one in with an amended return either. (Unlike Schedule C, D, etc.)
