    50% Special Depreciation

    Can property that is not eligible for Sec 179 deductions be eligible for the 50% special depreciation allowance? As an example, would a new refrigerator used in a rental property (the rental property is not a trade or business but used for the production of income) qualify??

    The rules for the special depreciation state that you use Sec 179 deductions first. If you have zero deductions for 179, because the property does not qualify, does that mean you
    can't use the 50% allowance?

    From Pub. 527 page 8


    For 2009, your residential rental property may
    qualify for a special 30% or 50% depreciation
    allowance. This allowance is figured before you
    figure your regular depreciation deduction.
