    Calif Abatement of Penalties

    Have any of the California people been successful in receiving abatement of penalties for late filing due to reasonable cause - such as illness, financial, etc.

    I was successful in obtaining the one time abatement on Federal ( $ 5,000+) and was going to try for the Franchise Tax Board in Califonria ($1,500)- any words of wisdom????

    Bump it Up

    Sandy, obviously I don't have an answer to the CA penalty abatement, but I do have a California question. With your permission, I'll piggyback my question on your original post, and in the process, bump the thread back up.

    I've got a new Tennessee customer who will have non-resident income (a W-2) from California. Being as where I am not a California preparer with not the first iota of registration, am I going to run into a buzzsaw of administrative hurdles by filing a non-resident return on this guy? If so, I'm going to send him somewhere else.

      California Stuff

      Sandy: Since California is broke, I would imagine that the tightfisted FTB will try to stick you with the Penalty. I would write the letter to the FTB stating your reasonable cause and also mention, and attach if it would help, the Federal approval to the waiver of penalties. That way you set a precedent as the Federal approved it.

      As for the Client with the CA W-2, you have to file a 540-NR. Should be no big deal. I would also imagine that your client may be entitled to the "Other State Tax Credit" for any Ca tax.

          Thanks DMICPA - I have never had to file for an abatement at FTB - and this last year FTB, BOE and EDD have been the worse agencies to work with ever - The Advocacy Group I don't believe will be of any help. The entire California system is turning a "deaf ear" and a "blind eye" on almost anything!

          I have a BOE appeal in January that I am beginning to believe is just an exercise, as the law states the taxpayer is entitled to it - but seems in conversation all have made up their minds

          So I am preparing the package the same as submitted to IRS and forwarding IRS acceptance, and hope that FTB will acknowledge. The penalties and fees have already been paid - client knows that we are not hopeful on this and if we receive a favorable decision, it is just a plus .
