Just attended a training workshop with the NYC Department of Consumer Affairs. If you offer bank products you cannot:
(i) Advertise that you offer "Rapid," "Instant," or "24-Hour or Less" bank product. If you do, you will be cited.
(ii) You must display details of your billings noticeably and must give detailed receipt to clients.
(iii) Can't charge Tax Preparation fee, service or prosessing fee for RAL clients.
(iv) If you are not an attorney, CPA or EA, you must display your qualifications.
(v) Can't refer to your self as Tax "Consultant," "Expert" "Genius." In the case, of the consulting, they say you can't just use the word loosely.
My suggestion is, if you are in NY and didn't attend the workshop you need to have an understanding of the rules. close to 300 preparers were cited last year by DCA. It's like they are coming with the BIG Gun this coming season; and not just till April 15.
