    Buying a practice

    I'm looking for a confidential release form for clients coming into our practice from another.

    Anyone have something to share?

    I'm confused??(not unusual)... Who is going to sign this form? Every new client?

    It sounds like something the selling practioner would do, not the buying practioner. If the selling practioner won't release his clients info to you without his clients permission then I guess you need to have your new clients sign the form at the first meeting...???. You know, the ones that show up.

    This is one reason why I like a one year relationship with the selling practioner, no client approvals needed.

      The practioner

      is going to work for us.

      My assumption is the records are in her posession and since we are a seperate entity a release would be required.

        You could be right since the seller is going to be an employee, not a partner.

          Would you then be a third-party processor until all clients are notified of the take-over/merger. As each client is assigned to a new preparer a release could be signed for the records from the old owner.

          I don't know about this whole issue. I would think once a client voluntarily sits with a new preparer he would automatically want any records passed on to the new preparer without any signed authorization.

          But if it makes you feel better, a simple authorization form can be designed:

          I authorize (Old Preparer Firm) to give my tax records to ( New Preparer Firm).
