    Can't File A Timely Accurate Return

    I am just about finished preparing a 2006 return for a client.

    I just found out that in late 2008 the IRS assessed my client's spouse based on the tax records they had on file and issued a notice of deficiency.

    Can I file the 2006 return I have prepared, or must I file an amendment?

    Timely Return

    You file a return.The SFR that IRS did is not a return so you can not amend it you file a 1040 which replaces thE SFR.

      That is exaxtly the protocol I used for a non filer earlier this year and all ended well.
