    Divorce problem

    Client and husband haven't filed for several years. Worked on 04, working on 05. In 06, couple was married, my client stayed at home with kids, no income. The mortgage for the home was in her name. IRS is questioning how she paid mortgage w/o income. She is going to file MFS in 05, (can't get husband to file) and she has 1099's in her name. She doesn't need to file MFS in 06,(no income) but what should she do to let IRS know she was married and husband paid mortgage? Should she file MFS without income? Couple is now divorced and she wants to distance herself from his tax problems.

    I assume your client has been tagged with the IRS' new program to check into non filers with 1098 forms. So just write back and explain the facts.
