I'm filing a late return for an older couple for 2007. The husband (on SS) filed as MFS-- a paper only thing in order to get his stimulus check. Now the wife who has a businss is filing, if I file it as MFS they will pay much more than the 300.00 he got for stimulus as opposed to filing MFJ. I don't know how to do this, as there is really nothing to ammend. Help!!!!!!

I believe the correct course of action would be to amend his return and change to MFJ and add her information. You will have to be sure to include his $300 stimulus payment so they do not get a credit for it again. If she has enough income she will be eligible for $600 in recovery rebate credit and that will help. doing this will require sending nearly the entire return with the 1040x as most of it will change.AJ, EA

Davis was correct about the stimulus payment, I have been doing so many 2008 amends lately I was mixing the two.
If you are working in a decent software of any kind, you can have his information saved as the "as filed" column, then do the entire return as MFJ with all of her information. When you are done the amended column will be for the joint return and the differences will calculate for you.
If you do not have his in, enter his first as originally filed and then add hers. On many programs you can just enter the "as originally filed" column with out doing his entire return, although as little as he had, I believe I would get an exact match and then go to the amended screen and proceed from there.
In direct answer to your question, yes you will have to do and include all of her forms with the 1040X. Too bad we can not efile amended returns, would make it easier.AJ, EA
