    part-year resident

    I have a college student who moved from AL to OK in august2008 (is going to school in OK and going to stay through the summer to work etc. to gain residency in OK). Since he is not considered a resident in OK until the year of physical presence is met, would he be considered a resident of AL for 2008 and part-year resident for OK? or non resident for OK?

    There is some Choice

    There are some options here. However, he cannot be a full-year resident in one state and a part-year resident in another.

    He can elect to remain a resident of Alabama, and be a non-resident of OK. If her worked in OK, this would required him to file a non-resident OK return to get a refund of state taxes withheld. He would have to report the same income on his Alabama return, but could take the credit for taxes paid to other states.

    Or he can assume residency in OK for part-year, and file part-year returns in BOTH states.

    Most people choose to retain their home state of residency when attending college, unless they intend to remain in their college state after graduation.

      doesn't really let anyone "elect" to be a resident. You either are or not. If you were
      a resident before you moved, for whatever reason, you still are a resident of Alabama
      until you take affirmative steps to establish bona fide residency in another state.

      Long time ago, this fellow moved up to nashville to work at Radio shack up there, but was
      back within 9 months. He never did do what was necessary to establish residency up thar, so Alabama wanted full income tax on his full earnings.

      You can of course see why I was trying to get him recognized as a Tennesean during
      the time. (grin
