    i 's pretty sure of the answer to this question but just want to confirm. married couple who live together would save tax by filing seperate. jointly their income would cause the child credit to phase out. they have 4 children. if file seperately and the wife claims all 4 children they would get a larger child credit. the husband earns the higher income. can either spouse take the children as dependents? i think so. the tie breaker rules only apply if both parents claimed the children. i'm pretty sure wife can take all four kids?

    I agree.

    The child tax credit is the only credit available MFS and one of the rare instances when MFS is more advantagous.
