    Education Credits

Have client who is grown and has been working for many years. Going to college now to become RN. Is in first year of college. Never had college in past. Hope or LLC.

Her daughter is going to two year college. Is in second year however is considered by the college as a senior. Hope or LLC.

See TTB page12-1 through 12-3 for requirements and comparisons of the credits. In your case, I would say both qualify for the Hope credit. As long as the mom is carrying at least 1/2 full-time workload, she should qualify since this is her first post-secondary education. Daughter should qualify since this is her second year of college - provided she has not already taken the Hope in two prior years. The fact that the college considers her a "senior" does not factor into the situation.

Maybe not in this situation but if it is the other way round and the student is in the third year of college than the Hope Credit can be taken if the number of years for the Hope Credit is not exhausted yet.

is in her second year at THAT college, but why would it consider her a senior if she did not
already have enough credits to merit that rank? I'm wondering if daughter didn't attend
another college sometime in the past although she may only have attended present school
          for a year plus.

I've also heard of "senior" being thrown around for a 2nd year student in a community college, since it's their "final" year in a 2-year school. In the way some 8th grade students would call themself a senior. I haven't seen a school itself do it though, just the students.

That would be something I'd verify with the taxpayer since senior would normally imply 4th year.

You could ask if the daughter has yet earned an associates degree, if so has already had two years.
