Form 3903 in 2008 and again in 2009?

My client started his relocating in 2008 and will be completing his relocation in 2009. Any problem with my client filing a 3903 for 2008 and another 3903 for 2009? He qualifies via the mileage test and the employment.

Yes, I see a problem. I think you are allowed one trip for yourself and one trip for your belongings. Could you elaborate on what exactly you mean by starting and finishing the move?

But other than that it is OK to use the two forms on different years because of the timing of the move. For instance moving van expenses paid in 08 and the car trips to the new home by family members made in 09.

T/P is limited to one trip per person. From TTB:

        Deductible moving expenses:
        • The cost of transportation and storage (up to 30 days after
the move) of household goods and personal effects.
        • Travel, including lodging, from the old home to the new
home. Travel is limited to one trip per person. However,
each member of the household can move separately and
at separate times. If the taxpayer drives his or her own
vehicle, expenses can be figured either using actual outof-
pocket expenses for gas and oil (but not depreciation),
or the standard mileage rate for moving (for 2008, 19¢ per
mile before July 1, and 27¢ per mile after June 30) (see
page 10-1), plus parking fees and tolls.
You have the right to remain silent. Anything you say will be misquoted, then used against you.
