    divorced retired teacher

    Divorced Retired teacher while married, had wife listed as beneficiary for Calstrs retirement. Calstrs withdraws $800/month every month from his retirement and puts it in a fund and upon his death will disburse to his wife. But he divorced his wife a couple of years ago, and the retirement was not addressed in the divorce settlement, so now he is stuck with losing $800/month out of his retirement. Is there a way he can stop the $800 draws from his retirement every month, without having to go to an attorney??

    Just A Thought....

    He might try to contact the state teacher's retirement plan directly and ask them. I know years ago things were set in stone but my husband's employer (State of Indiana) just recently made some changes in their plan because "things don't always stay the same."

    If all else fails, he (or she) may have to get an attorney involved.

      California is a community property State, and if your t/p was married for more than 10 years (I believe), the ex spouse would be entitled to a portion of his retirement. And as such could file a QDRO.

      I believe the amount should cease at the point of the separation or divorce, however, her account might not reflect the full amount she would be entitled to, but then again it could reflect more.

      So whether it is elective on his part through CalSTRS or an attonrey becomes involved, he will have to pay part of his retirment to her.

      Legal action might reduce the amount and cease future amount , but at the same time, could increase an amount that would be due her account.

        thanks Sandy, he was only married for 7 years to her, would that make a difference? Whether it was elective or not I would have to ask him.
