    Stimulus filing

Client as Head of Household claiming his mother ( on Social Security) as dependent. Client received $600 Stimulus check. Mother did not receive check. Mother has not file a return since receiving SS. Can his mother file a 2008 return to get her stimulus check?

    Dependent

A dependent does not qualify for a stimulus payment. If mom is not a dependent for 2008, they she can file to receive her credit now.

she cannot get a recovery rebate credit as she is a dependent on some one else's return.

First of all, dependent status is not based on how the checks can be obtained, but rather who paid over half the support for the mother - she or her son.

But if she receives social security benefits she will get the $250 stimulus payment for this year regardless.

Not to throw a curve ball here, but I was taught that if someone is a dependent then they are a dependent. Your client could take her off the return, but could the dependent claim herself if she really is a dependent?

No without filing a false return.

Agree. A taxpayer cannot claim their own exemption, if ELIGIBLE to be claimed on another taxpayer's return. Does not matter if that other taxpayer does not claim the exemption.
