Just checking to make sure I have this correct. Amend 06 return must be done on or before 4-15-2010, the date 2009 tax return is due w/o filing an extension.

what IF it's other way around and tax is due?
There is no "must" in all cases you see.ChEAr$,

and in that condition I hate to suggest this but isn't the deadline to claim a refund for an 06 return 4/15/09? The return was due 4/15/07 so on 4/15/08 you have the second year and 4/15/09 the third? Do you in other words really get that fourth year?
Also Harlan's point about "what if the taxpayer owes on the amend?" is well taken. In that event the interest and penalties are piling up as we speak.

3 years after a 2006 tax return due date calculates to 4/15/2010
The due date is
4/15/2007 to 4/15/08= 1 year
4/15/2008 to 4/15/09= 2 years
4/15/2009 to 4/15/10= 3 years
Baby born 4/15/2007 is three years old on 4/15/2010
