    Client let IRS refund go stale

    How do I go about getting a refund check from IRS reissued? The client let it go stale. Actually, his attorneys were sitting on it during his divorce. But that's another story...

    I would contact the IRS. I know that I've had clients lose their checks and we've had a new one re-issued, but I've never had anyone not cash it. Perhaps the lawers should handle this since they "sat on " the check instead of having it cashed and holding the proceeds in a custodial account.

        Why not start with the state if it's sitting in unclaimed funds? Go to the state website for instructions on how to claim the money. If the check has an expired date to be cashed by, it would still make it easier to obtain a replacement.

              Does client still have the check? Fill out the request for refund form and attach the check asking for a new one to be issued. taxea

                I'd fill out the form and let the client attach the check. The last thing you need this time of year is an office that smells of attorney butt.

                    IRS Form 3911 is a statement sent by the IRS concerning refunds. The IRS will send this form if a refund check that it has sent has not been cashed in a timely fashion or was undeliverable. The taxpayer will need to fill in Sections I and II, and attesting to the fate of the check. A replacement check may be sent if the original was lost or destroyed, but the taxpayer will be obliged to return the first one if it is found. If the taxpayer uses direct deposit, then banking information will need to be supplied.

                        In less time it took you to ask for the form number and wait for an answer you could have looked it up. I'm not being rude but we are all busy and rely on each other for situations that may be foreign to us. It just isn't fair to expect simple basic research that you have the capability and knowledge to do. taxea

                          I go back to my original premise that you enjoy a good argument OR maybe you are in the employ of the board to keep things interesting OR maybe you are related to a well-liked and now banned poster who really loved a good argument and would mix things up quite a bit. But he also -like you - had a lot of constructive things to say.
