    First time home buy tax credit

    Case:

    A married couple bought a house in 2008.

    Neither of them has owned a home in the last three years before the purchase.

    Husband has been living there ever since the purchase.

    Wife is working in another state. So she did not live in that house at all in 2008. But she planned to quit the job and move to the house and make it her principal residence in 2009.

    Does the wife pass the test?

    Were they living together before they bought the house?

    It might be a temporary absence...

    If her name is on the deed and on the mortgage note, that demonstrates an intent to permanently relocate.

    How much of a gap was there?

    For example, did they buy the house in late October, and she just stayed behind to wrap things up, and then moved in January, 2009?

    Or did they buy the house in early May, and she still hasn't moved?

    Is she seeing somebody? LMAO

    I think this is one of those facts-and-circumstances things...
