You file a Form 1041 for as long as the estate stays open. However, you can elect a fiscal year, which starts with the date of death and continues until the end of the month just prior to the month of death in the following year. For example, date of death is 2/20/08. Fiscal year is from 2/20/08 up to and including 1/31/09. If distributions are made and K-1's issued in this case, they would go in the individual's 2009 tax year. Or you can elect a calendar year which ends on 12/31/08. Or you can do a short year which ends when all assets have been distributed, bills paid, etc.
