    Sch A medical deduction

    Man and woman live together with their child. Woman works and claims HofH and daughter. Man actually should claim HOH and child but doesn't want to upset the woman (afraid she will take daughter away) Oh well, that's another story. Everyone lives together in one home that the man pays all expenses for. He also pays woman's and his child's health insurance and medical expenses. Can he claim those medical expenses on his Sch A? TTB 4-5 talks about other reasons to be able to claim expenses when individuals are not his tax exemptions. ( #3 Person being supported by taxpayer made $3500 or more during year) Any opinions?

    For the child, I would take their medical expenses on the man's return. Ref pub 17, p. 142 for definition of dependent for the purpose of medical expense deductions. The child is the man's QC, so he's qualified to claim their expenses. To take the woman's expenses, she needs to qualify as his QR without regard to her earnings, but with regard to whether he provides over 50% of her support, which you didn't mention, though you did mention she works. (Without getting into the HOH issue you raised.)

      He does provide over 50% of her support. Housing, insurance, vehicle. Sure would help him out since he can't take HOH

        If mother doesn't pay over 50% for housing, she cannot claim HOH. Then she can get mad at IRS.

          She can't take HOH if he is supporting the household expenses. He can't take her if she makes 3500+. He can only take medical expenses for the child if the child can qualify as his dependent. taxea
