Client sold rental property in 2008. The settlement statement shows part of the contract price withheld to pay Property Taxes for the year. I know that the seller can only deduct a prorated share of the property taxes based on number of days he owned the property during the property tax year. However, is this amount withheld a deductible selling expense? Or does the seller have to include in his amount realized for determining gain on the sale?
