Any update on $7,500 FTHB in regards to payback requirement?

If bought in 2008, it's still $7500 and must be paid back. If bought in 2009 it's $8000 and not paid back.

will the purchase in 2009 be handled on a 2008 return? I have one waiting to be done where the person bought the house after Jan 1 should we expect the IRS will pick-up on this and give the full $8000 credit?
