    HOH problem

    Young couple came in last year, not married but living together. His income is 4x her income and he owns the home they live in. No problem, two single returns. This year they have a child. Still not married but well schooled in the EITC. She wants to claim the child and the EITC. He wants to claim HOH. I can’t legally see why they can’t but it still seems wrong. His income is way too high for EITC but he would use the CTC.
    In other words, a democratic government is the only one in which those who vote for a tax can escape the obligation to pay it.

    He cannot file HOH since he will have no dependents on his tax return.

      See TTB 3-17 -- QC of More Than One Person. They can choose who claims child, but whatever tax benefits they qualify for go to just one of the parties.
